At the beginning of July, Law 13,853 of 2019 was sanctioned, which amends the LGPD - General Data Protection Law 13,709 of 2018. In addition to making some points more flexible, it also creates the National Data Protection Authority. From this, people's rights in relation to their data are defined, who can process this information and under what conditions. The main objective is to guarantee the privacy of personal data, in addition to creating clear rules on the processes for collecting, storing and sharing this information. As a result, from 2020 onwards, companies that include customer information in their database, even if it is as simple as name and email, will have to follow the procedures set out in the new law, under penalty of very considerable fines.
New law changes the LGPD
The new law that changes the LGPD will be Brother cell phone list applied to all sectors, being extraterritorial, that is, even if a certain company is not headquartered in Brazil, if it does business in the country, it will have to adapt. Users must be aware of and consent to the collection of their personal data, and may request the rectification, cancellation or even deletion of this data. It will be the companies' responsibility to ensure the security of personal data retained in their system, as well as to communicate to the user about possible security problems and illegal access to data. Furthermore, companies will have to demonstrate that the data they collect is, in fact, necessary and serves a business purpose. In relation to personal data of children and adolescents, there is also a specification, and obtaining the same must be consented to by one of the parents, before it is even stored.
Fine and inspection
Companies that do not comply with the LGPD are subject to several penalties, including one that touches directly on their pockets and includes a fine of up to 2% of the company's revenue in question, with the maximum value of the sanction being R$50 million. The ANPD - National Data Protection Authority will be the body responsible for monitoring compliance with the LGPD. It will function as a regulatory agency and will have 23 technical professionals, five of whom will be members of the Board of Directors, under the choice and appointment of the President of the Republic, after approval by the Federal Senate, and will occupy commissioned positions. The ANPD will be directly subordinate to the Presidency of the Republic for the first two years of its implementation and will then be transformed into an autarchy.
