This week, the Federal Justice Council approved the draft law that provides for the costs owed to the Union in the Federal Courts of the first and second degrees. According to the text, the monetary correction index for judicial fees to be adopted to readjust values will be the IPCA (Broad National Consumer Price Index), published by the Brazilian Institute of Geography and Statistics (IBGE), or another that will replace it. it. The draft provides that this index will be reviewed annually by the CJF.
The draft was approved by the rapporteur, minister João Otávio de Noronha, general inspector of the Federal Justice, with adjustments proposed in the approved vote of counselor Marge Inge Barth Tessler, president of the Federal Regional Court of the th Region. The judge suggested that a provision be added to the text that regulates the reimbursement of amounts collected in excess as a result of an error in the calculation. In this case, the amount could be reimbursed upon request by the interested party to the judicial authority responsible for the management unit.
One of the innovations of the current draft is the addition of values referring to the cost of scanning procedural documents in cases where the parties present documents and documents only in physical form.
The current Costs Law (Law ,) dates back to , and stil BTC Number Datal uses the Fiscal Reference Unit (UFIR) as an index for costs values, which were frozen after the extinction of the UFIR. Furthermore, the creation of Special Federal Courts in brought another reality, not foreseen in this law.
The cost tables contained in the proposed text also include events and incidents within the jurisdiction of federal regional courts, a provision that does not exist in current law. To this end, the tables of state courts and the Federal Supreme Court were researched, with the proposed values being compatible with those charged by these bodies.
Among the entities exempt from paying costs, the draft includes the Federal Public Defender's Office and the Brazilian Bar Association, the latter in cases of actions in which it acts in defense of the public interest.
The original draft law had been approved by the CJF in and sent to the Ministry of Justice by the then president of the CJF and the STJ, minister Raphael de Barros Monteiro. The text, however, remained in the Judiciary Reform Secretariat of that Ministry until , when the current president of the CJF, minister Ari Pargendler, requested its return, so that the necessary updates could be made.
